The RoHS Directive
Restriction of Hazardous Substances (RoHS) is a directive of the European Union (EU), which took effect July 1, 2006. Aimed at protecting health and environment, this directive mandates that electronics products sold in the EU must be essentially void of six hazardous substances: lead, mercury, cadmium, hexavalent chromium, and PBB and PBDE flame retardants. Since lead is present in virtually every solder joint and lead finish, these new regulations directly impact the entire supply chain of the electronics industry. Your company MUST conform to the RoHS standards if you export electrical and/or electronic equipment to the EU countries.
Product Returns for Repair
In the event that a product return for factory repair
is indicated, your Representative or Distributor can
arrange this for you and explain the returns procedure. Please consult
your
product manual for details on warranty limitations and status. For product
returns, please be prepared to answer questions about the pump serial#,
(see the "How to Identify your Pump" page)
application details (fluid mix, pressure, capacity, temperature, duty
cycle, etc.), and any other symptoms and indications that might help
us
determine the root cause of the problem, and avoid it in the future.
If you require complete failure analysis, please return the pump in an
assembled
and unaltered condition. The actual disassembly process often gives indications
of failure modes so this is very important to consider. In some circumstances,
customer disassembly may void your warranty.
Also be aware that for the safety of our personnel, and to meet OSHA requirements,
we require a disclosure of the composition of the fluids pumped before
an RMA authorization will be issued. The customer is then required to send
an MSDS sheet in advance (or on the outside of the pump return
packaging), and then thoroughly flush the unit if the fluid is anything
other than clean water or ethylene glycol.
Product returns will generally be processed within a few days of receipt
and a faxed advisement will be sent with our findings and recommendations.
Expedited return and repair may be arranged upon special request. To request
an RGA (Return Goods Authorization) number, please click
here to submit
a request.

California Proposition 65
Effective Date: 30 August 2018
MTH Tool Company, Inc. (hereinafter referred to as "MTH") is committed to comply with all laws and regulations pertaining to its operations and its products. One such regulation is the State of California Proposition 65. http://www.p65warnings.ca.gov.
Q: What is California Proposition 65 and what are the requirements?
A: In 1986, California voters approved the Safe Drinking Water and Toxic Enforcement Act known as Proposition 65. Proposition 65 mandates that the Governor of California maintain and publish a list of chemicals that are known to cause cancer, birth defects and/or other reproductive harm. The list, which must be updated annually, includes a wide variety of chemicals that can be found in dyes, solvents, drugs, food-additives, by- products of certain processes, pesticides and tobacco products. A company with ten or more employees that operates within the State of California (or sells products in California) must comply with the requirements of Proposition 65. To comply, businesses are: (1) prohibited from knowingly discharging listed chemicals into sources of drinking water; and (2) required to provide a "clear and reasonable" warning before knowingly and intentionally exposing anyone to a listed chemical. In 2017, California updated the warning rules and products containing Proposition 65 substances must now carry a new warning statement unless they can be shown to not have an exposure risk.
Warning short form - Example
Q: Why do some MTH products have a Proposition 65 warning on them?
A: A Proposition 65 warning means one of two things: (1) the business has evaluated the exposure and has concluded that it exceeds the "no significant risk level"; or (2) the business has chosen to provide a warning simply based on its knowledge about the presence of a listed chemical without attempting to evaluate the exposure.
MTH and many of its manufacturing partners have chosen to provide a warning based on its knowledge about the presence of one or more listed chemicals without attempting to evaluate the level of exposure. With MTH’s products, the exposure may be negligible or well within the “no significant risk” range.
However, out of an abundance of caution, MTH has elected to place the Proposition 65 warning signs on its products if applicable or potentially applicable.
MTH is committed to providing safe, high quality products for our customers and we have worked with our suppliers and our supply chain partners to ensure the purchase of raw materials that will meet Prop 65 standards and our labelling.
Q: How can customers trust that our product is safe?
A: If a Proposition 65 warning is posted on the product or product packaging, it means that one or more listed chemicals is present in the product in some quantity. The California state government has clarified the statute by stating that “The fact that a product bears a Proposition 65 warning does not mean by itself that the product is unsafe.” California has also explained, “You could think of Proposition 65 more as a ‘right to know’ law than a pure product safety law.” See http://www.p65warnings.ca.gov.
It is the responsibility of the user to determine the suitability of the subject product for any particular use or application. If you have any questions or concerns regarding the Proposition 65 warning, please contact us.
